In Michigan we have No-Fault insurance. That means there are two separate types of benefits available to you.
The first is called “first-party benefits”. You collect from your own insurance carrier for all reasonable and necessary medical expenses incurred as a result of the auto accident. This is a lifetime benefit. You can also collect 85% of your first three years of wage loss. Lastly, you can collect replacement services up to $20 per day for three years. This allows you to pay people to provide services that you are no longer able to do for yourself.
The second benefit is called “third-party benefits”. If you have sustained a serious impairment of a body function, have a permanent, serious disfigurement, or you have died - yup - you may sue the at-fault driver for wage loss beyond three years, pain and suffering, mental anguish, loss of the body function and scars.
